Constitutional Commissions Of Nepal
The Constitution of Nepal part 27 has made the provision of some other Constitutional Commissions. Each commission consists of a chairperson and four other members. The chief and members of all these Commissions are appointed by the President on the recommendation of Constitutional Council. Their terms of office is 6 years. A brief description of each of them is as follows:
National Women Commission
There is a provision of the National Women Commission in article 252 of the Constitution of Nepal to carry out the following functions related to women
- To make policies and programmes for women welfare.Â
- To review whether or not the international commitment related to women are implemented and suggest the effective measures for their implementation to the governmentÂ
- To assess, supervise and evaluate the policies and programmes related to the inclusion of women and suggest the government for their effective implementation.Â
- To make recommendation to the concerned authority to file case in the court against gender violence.Â
National Dalit CommissionÂ
The Constitution of Nepal has made a provision of National Dalit Commission in article 255 of the Constitution of Nepal. The following are its functions
- To work in the favour of Dalit Community, to initiate to end of caste discrimination, untouchability and exploitation to Dalits.Â
- To make effective policies and programmes for the welfare of Dalits and present it to the Government of Nepal.Â
- To evaluate the present policies and programmes of Dalits for bringing them in the mainstream of the nation.Â
- To monitor whether the special provisions and laws related to the welfare of Dalit are implemented or not.
National Inclusion CommissionÂ
National Inclusion Commission has been provisioned in Article 258 of the Constitution of Nepal. The following are its functions.
- The commission is constituted for the welfare of Khas Arya, backwarded community, physically challenged, senior citizens, labourers, peasants, minorities and marginalized groups.Â
- To conduct study and research related to these communities and make policies for inclusion, study the implementation aspects and give necessary suggestions to the government.Â
- To give suggestions to the government for the progress and prosperity of targeted region, class and community.
Adibasi Janajati CommissionÂ
The Constitution of Nepal has made the provision of Adibasi Janajati Commission in article 261. Its functions are as follows:
- To make policy related to Adibasi Janajati.Â
- To work for their welfare and empowerment and give necessary suggestions to the government.Â
Madeshi CommissionÂ
The Constitution of Nepal has made the provision of Madeshi Commission in article 262. The functions, duties and power of this commission would be according to the federal law.
Tharu CommissionÂ
There is a provision of Tharu Commission in article 263 of the Constitution of Nepal for the welfare and empowerment of Tharu Community. Its functions, powers and duties would be determined as per the federal law.
Muslim CommissionÂ
The provision of Muslim Commission has been made in article 264 of the Constitution of Nepal. The aim of government to constitute this commission is to bring the Muslim communities of Nepal in the mainstream of nation.Â
QualificationsÂ
The following qualifications are needed in general for the chairpersons and members of these Constitutional Commissions.
- Should be the citizen of Nepal.Â
- Should have completed the age of 45.Â
- Should not be the member of any political party.Â
- Should have high moral character.Â
- Should have made valuable contribution in the related field for at least ten years for chairperson.Â
-  Should be a graduate from the recognised university by the government of Nepal. Â
